Acceptance of Terms

By accessing or using LenderHawk (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Your continued use of the Service after any changes to these terms constitutes acceptance of those changes.

Description of Service

LenderHawk is a marketplace and information platform that helps borrowers research and connect with SBA lenders using publicly available data from the Small Business Administration (SBA). The Service provides lender search, comparison tools, market analysis, educational content, and may facilitate introductions or referrals between borrowers and lenders.

Important to understand:

LenderHawk is not a lender, bank, or financial institution and does not make credit decisions
LenderHawk does not originate, fund, or guarantee any loans
LenderHawk is not a fiduciary and does not provide financial, legal, or tax advice
LenderHawk may receive compensation from lenders, advertisers, or other third parties for referrals, leads, advertising, or other services (see Section 05)
LenderHawk may act as a referral source, marketing partner, or agent in connection with lenders and other financial service providers listed on the platform

The presence of a lender on LenderHawk does not constitute an endorsement. Compensation arrangements may affect the placement, ordering, or prominence of lender listings.

Use of Data

The lending data displayed on LenderHawk is compiled from publicly available SBA loan-level records. While the underlying records are public, the compilation, analysis, formatting, and presentation of this data represents substantial original work.

You may use the Service for personal, non-commercial research purposes. You may not:

Scrape, crawl, or systematically extract data from the Service
Reproduce, redistribute, or republish compiled data or analysis
Use automated tools to access the Service (except standard search engine crawlers)
Create derivative products or services from our compiled data

Intellectual Property

The following are proprietary to LenderHawk and protected by applicable intellectual property laws: our compiled and analyzed lending datasets, ranking algorithms and methodology, spread estimation models, market analysis and insights, website design and user interface, and all original content including guides, articles, and educational materials.

Compensation, Advertising & Data

LenderHawk is a free service to borrowers. We may be compensated by lenders, advertisers, and other third parties through a variety of arrangements, including but not limited to:

Referral and lead fees. We may receive compensation from lenders or other financial service providers when we refer, introduce, or connect borrowers to them, or when a borrower takes an action such as submitting an application, requesting a quote, or funding a loan.
Advertising and sponsorship. We may display paid advertisements, sponsored content, featured listings, or promoted placements on the Service. Compensation may affect how and where products, lenders, or offers appear on the Service, including the order in which they are displayed.
Data products and licensing. We may create, sell, license, or distribute aggregate market data, compiled analytics, reports, datasets, and intelligence products derived from publicly available lending records and anonymized platform usage data.
Partnerships and integrations. We may enter into commercial relationships with lenders, brokers, financial technology companies, and other partners, and may receive compensation for services including marketing, technology integration, co-branding, and distribution.

By submitting your information through the Service, including search queries, contact information, and business details, you grant LenderHawk a perpetual, non-exclusive, irrevocable, royalty-free license to use, reproduce, adapt, distribute, and make available such information in connection with the Service and our business operations, including sharing with trusted partners and lenders.

Communications & Consent

By providing your contact information, business information, or other details through the Service, you expressly consent to receive communications from LenderHawk and from third parties with whom we have business relationships, including lenders, financial service providers, and partners. Communications may be sent via email, telephone, text message, or other channels and may include:

Lender introductions, financing offers, and rate information
Service updates, market insights, and educational content
Responses to your inquiries and follow-up communications
Promotional offers from LenderHawk and selected partners

You may opt out of non-essential communications at any time by following the unsubscribe instructions in any email or by contacting us at founders@lenderhawk.com. Opting out of marketing communications does not affect our ability to send transactional or operational messages.

We may share your information with lenders and partners you have expressed interest in, or who we believe may offer products relevant to your search criteria. See our Privacy Policy for details on how your information is shared.

User-Generated Content

By submitting content to the Service (including but not limited to reviews, ratings, comments, and feedback), you grant LenderHawk a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, display, and distribute that content in connection with the Service and our business operations.

Not financial advice. Nothing on LenderHawk constitutes financial, legal, tax, or investment advice. Always consult a qualified professional before making financial decisions.
Data accuracy. Our data comes from public SBA loan-level records, which may contain errors or omissions. Spread estimates are calculated from loan approval data and may not reflect final loan terms.
No guarantees. We do not guarantee the accuracy, completeness, or timeliness of any information on the Service. Lender terms, rates, and availability change frequently.
No endorsement. Listing a lender on LenderHawk does not constitute an endorsement. Rankings reflect historical data, not a recommendation to use any particular lender.

Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. LENDERHAWK’S AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE (CURRENTLY $0 FOR FREE USERS).

IN NO EVENT SHALL LENDERHAWK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Changes to Terms

We may update these Terms of Service at any time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
